Alcohol and major offenses
Operating a CMV at 0.04 percent BAC or more is illegal, and detectable alcohol below 0.04 produces a 24-hour out-of-service period. A first major offense normally causes at least one year of disqualification and at least three years when committed in a placarded hazardous-materials CMV.
Serious and railroad violations
Two serious traffic violations within three years produce at least 60 days of disqualification; three or more produce at least 120 days. Railroad-highway crossing violations escalate from at least 60 days to 120 days and then one year for a third within three years.
Mandatory notices
Notify the employer within 30 days of a traffic conviction, notify the licensing state within 30 days of an out-of-state conviction, and notify the employer within two business days of suspension, revocation, cancellation, or disqualification. Commercial job applications can require ten years of driving-employment history.
Clearinghouse transactions
Service Oklahoma checks FMCSA Drug and Alcohol Clearinghouse status when issuing, transferring, renewing, replacing, or upgrading a CDL or CLP. A prohibited status stops the transaction and can result in downgrade until the driver completes the federal return-to-duty process or successfully resolves an appeal.
Three-year restoration window
A driver downgraded because of a prohibited Clearinghouse status has three years to become not prohibited and seek restoration without complete retesting. After three years, the driver must reapply, pass the required knowledge tests, obtain and hold a CLP, and pass the skills test.
