Four driving types
Every New York CLP or CDL holder self-certifies as Non-Excepted Interstate (NI), Excepted Interstate (EI), Non-Excepted Intrastate (NA), or Excepted Intrastate (EA). Interstate includes cargo or passengers that are part of a trip crossing state or national boundaries even if one particular leg stays inside New York. A driver who performs both interstate and intrastate work chooses interstate.
Excepted versus non-excepted
Excepted categories are limited to the operations listed by DMV, such as specified government, emergency, school, medical, farm, custom-harvesting, beekeeper, and private nonbusiness passenger work. A person who performs both excepted and non-excepted work must select non-excepted to remain qualified for both.
Medical certificate requirement
NI and NA drivers must pass the USDOT physical with a medical examiner listed on the National Registry and keep certified medical status. EI and EA drivers show Not Required for medical certification, although other employer, Article 19-A, school, or state medical duties can still apply. A medical variance must remain current with FMCSA.
Electronic transmission
The certified medical examiner sends the examination result and certified status electronically through the federal system to New York DMV. The driver should check MyDMV rather than assuming the transmission succeeded. A paper card in the wallet does not by itself prove that the licensing record is Certified.
Expiration and restoration
When a required certificate expires, the driver is no longer certified to drive commercially and the record changes to Not Certified or medically not certified. After an updated certificate or variance arrives electronically, DMV can restore the status without an office visit. The driver must not operate a CMV during a lapse merely because a notice or grace expectation exists.
Exam focus
Apply the rule to the exact New York vehicle, credential, date, trip, applicant, test stage, and operating facts. Current NY DMV pages control time-sensitive procedures; CDL-10 controls the tested safety material unless a newer official notice expressly changes it.
