New York CDL Eligibility, Residency, Legal Presence, and Transfers

A New York CLP or CDL applicant must be a New York resident and present accepted residency evidence when applying, transferring, renewing, or amending. A driver who moves to New York with another state's CDL must surrender and exchange it within the applicable 30-day transfer period rather than keeping two commercial licenses.

Before taking a New York CDL permit test, the applicant must already hold a New York Class D, Class E, or Non-CDL Class C driver license. The underlying license and CLP travel together during practice. An out-of-state CDL transfer is handled as an exchange and includes New York document, medical, endorsement, and security checks.

Original and transfer transactions require the applicable citizenship, lawful-permanent-resident, identity, Social Security, legal-name, and legal-presence evidence. An original Class A or B applicant reports every state or District of Columbia license held during the prior ten years. An Enhanced New York license can satisfy a legal-presence step that a Standard or REAL ID applicant may need to document separately.

The current NY DMV application page states that offices are temporarily unable to accept CLP or CDL document applications from people who are not U.S. citizens or lawful permanent residents, described there as temporary visitors. This is a time-sensitive current procedure, not a timeless vehicle-safety rule, and must be rechecked against the live DMV page before publication or a transaction.

A person exchanging an out-of-state CDL with hazardous-material authority must pass the New York HazMat knowledge test and complete the required fingerprint-based federal and New York background checks. The unexpired endorsement does not simply copy to the New York credential without New York's testing and security process.
